1. GENERAL INFORMATION

These Terms and Conditions of Sale ("Terms") govern the purchase and use of products and services offered by Precision Complete B.V., a company registered in the Netherlands under KvK number 97366730, with registered address at Hofplein 20, 3032 AC Rotterdam, Netherlands ("Company", "we", "us", or "our").

By placing an order through our website, you ("Customer", "you", or "your") agree to be bound by these Terms. Please read them carefully before making a purchase.

2. PRODUCTS AND SERVICES

2.1 Product Range

We offer direct-to-consumer genetic testing products including:

  • Ancestry testing
  • Health predisposition analysis
  • Diet and nutrition genetic testing
  • Weight loss genetic analysis
  • Maternity and paternity testing
  • Methylation testing
  • Additional genetic testing services as may be offered from time to time

2.2 Product Information

All product descriptions, images, and specifications on our website are provided for informational purposes. We reserve the right to modify product offerings, descriptions, and prices without prior notice.

2.3 Educational Purpose

Our genetic testing products are intended for informational and educational purposes only. Results are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult with qualified healthcare professionals before making health-related decisions based on genetic test results.

3. ORDERING AND PAYMENT

3.1 Order Process

Orders can be placed through our e-commerce website. By submitting an order, you make an offer to purchase the selected products subject to these Terms.

3.2 Order Confirmation

We will send you an order confirmation email once your order is received. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order at our discretion.

3.3 Payment

  • All payments are processed securely through Stripe
  • Payment must be made in full at the time of ordering
  • We accept major credit cards and other payment methods available through Stripe
  • No payment plans or financing options are currently offered
  • Prices are displayed in Euros (€) and include applicable taxes

3.4 Pricing

All prices listed on our website include VAT where applicable. We reserve the right to change prices at any time without prior notice, but price changes will not affect orders already confirmed.

4. SHIPPING AND DELIVERY

4.1 Shipping Coverage

We ship exclusively within the European Union. Shipping costs are included in the product price at no additional charge to the customer.

4.2 Delivery Timeframe

Standard delivery time is 2-3 business days from order confirmation. Delivery times may vary during peak periods or due to circumstances beyond our control.

4.3 Delivery Address

You are responsible for providing accurate delivery information. We are not liable for delays or non-delivery due to incorrect address information provided by the customer.

4.4 Risk of Loss

Risk of loss and title to products pass to the customer upon delivery to the specified address.

5. RETURNS AND REFUNDS

5.1 Return Policy for Genetic Testing Kits

  • Unopened Kits: Full refund available within 30 days of delivery if the kit is unopened and unused
  • Return Shipping: Customer is responsible for return shipping costs unless the kit arrived damaged or defective
  • Used Kits: No returns or refunds are available once a sample has been collected and sent to the laboratory, as processing begins immediately

5.2 Damaged or Defective Products

If a kit arrives damaged or defective:

  • Contact us at info@precisioncomplete.nl within 7 days of delivery
  • We will provide a free replacement or full refund
  • Return shipping costs will be covered by us

5.3 Laboratory Processing Issues

If laboratory processing fails due to technical issues (not sample quality), we will provide a replacement kit or full refund at no additional cost.

5.4 Return Process

To initiate a return:

  1. Contact info@precisioncomplete.nl with your order number and reason for return
  2. Wait for return authorization before sending any products back
  3. Send returns to: Hofplein 20, 3032 AC Rotterdam, Netherlands

5.5 Refund Processing

Approved refunds will be processed within 5-10 business days to the original payment method.

5.6 Non-Refundable Services

DNA Data Analysis services, when purchased, are non-refundable once completed.

6. DATA PROTECTION AND PRIVACY

6.1 Genetic Data Handling

  • Your genetic data will be processed solely for the purpose of providing your requested genetic analysis
  • Genetic data will be permanently deleted 4 weeks after delivery of your report
  • You may request earlier deletion of your genetic data by contacting us at info@precisioncomplete.nl

6.2 Personal Information

We process personal information in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

6.3 Data Security

We implement appropriate technical and organizational measures to protect your personal and genetic information against unauthorized access, alteration, disclosure, or destruction.

7. SAMPLE COLLECTION AND PROCESSING

7.1 Sample Collection

You are responsible for following the sample collection instructions provided with your kit. Failure to follow instructions may result in processing delays or inability to generate results.

7.2 Sample Quality

We cannot guarantee results if samples are of insufficient quality. In such cases, we may offer a replacement kit at our discretion.

7.3 Processing Time

Laboratory processing typically takes 2-6 weeks from receipt of your sample. Processing times may vary depending on the type of test and laboratory workload.

8. INTELLECTUAL PROPERTY

All content on our website, including text, graphics, logos, images, and software, is the property of Precision Complete B.V. or its licensors and is protected by intellectual property laws.

9. LIMITATION OF LIABILITY

9.1 Disclaimer

Our genetic testing products are for informational purposes only. We make no warranties about the accuracy, completeness, or reliability of genetic test results.

9.2 Limitation

To the maximum extent permitted by law, our total liability for any claims arising from or related to our products or services shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

9.3 Exclusions

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

10. FORCE MAJEURE

We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, or technical failures.

11. GOVERNING LAW AND DISPUTES

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands.

11.2 Jurisdiction

Any disputes arising from these Terms or your use of our products shall be subject to the exclusive jurisdiction of the competent courts in Rotterdam, Netherlands.

11.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable consumer protection laws.

12. GENERAL PROVISIONS

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your purchase and use of our products.

12.2 Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

12.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
